Dear Sir or Madam:
The U.S. Nuclear Regulatory Commission (NRC) issued, in Reference 1, an immediately effective Order regarding additional actions needed prior to declaring operable the new Alert and Notification System (ANS) for Indian Point Nuclear Generating Station Units 2 and 3.
Entergy Nuclear Operations, Inc (ENO) provided, in Reference 2, the 7-Day report required by the July 2007 Order describing the steps and expected schedule for meeting the requirements.
ENO stated, in Reference 2, that a letter would be provided by August 17, 2007 if unresolved issues remain regarding placing the new ANS in service by August 24, 2007 On August 14, 2007, following the second of two successful full scale operational tests, ENO completed the installation and startup acceptance testing for the new ANS. The startup testing program included performance tests in the areas of:
" Communication and control system reliability
" Siren acoustic performance and audibility in the emergency planning zone (EPZ)
" Capability of the backup power design features required by NRC Order EA-05-190 and the Energy Policy Act of 2005.
NL-07-097 Dockets 50-247 and 50-286 Page 2 of 3 As a result of this testing program, ENO has reasonable assurance that the new ANS is capable of performing it's design function of alerting members of the public within the EPZ in the event of a radiological emergency at Indian Point Energy Center. ENO has also developed the required procedures for system operation and for implementing the preventative maintenance and testing program.
Reference 1 required that, prior to declaring the new ANS operable ENO would complete training of all the four county response organizations. Initial training for all four counties was conducted in early 2007 and additional final training is being conducted in August 2007 in anticipation of placing the new system in service. The additional training has been completed for three counties and training for the fourth county is scheduled to be completed on August 21, 2007.
Reference 1 also required that, prior to declaring the new ANS operable ENO would obtain FEMA approval of the new system. In Reference 2, ENO provided NRC with a description of interactions with FEMA, including documents and data that had been provided. ENO also identified in Reference 2 the issues and uncertainties regarding FEMA review and approval.
ENO continues to work with FEMA toward the resolution of the remaining issues.
In Reference 3, FEMA identified the remaining documents and data that it must review prior to formal approval of the ANS. ENO anticipates that the requested documents and data identified in Reference 3 including the results of an ambient acoustic background survey currently in progress, will be provided to FEMA by August 22, 2007.
ENO plans to meet with FEMA, NRC, and stakeholders on August 20, 2007 to discuss the actions that ENO is taking and the data that has been provided to resolve the remaining issues.
ENO anticipates that FEMA will require some period of time to review the information provided and is uncertain if FEMA review and approval will be completed in time to support the August 24, 2007 deadline established in Reference 1.
ENO believes that the new ANS is ready to be placed into service as the primary notification system pending the required review and approval by FEMA of the documents and data provided by ENO.
