Dear Mr. DeBey:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your June 21, 2007, letter requesting an exemption from the Fiscal Year 2007 annual fee for the U.S. Geological Surveys non-power reactor in Denver, Colorado, License R-113, Docket 50-274. Your letter cites 10 CFR 171.11(a)(2) as the basis for an exemption. I am granting your request for a fee exemption based on your certification that the non-power reactor in Denver, Colorado continues to be a federally-owned research reactor, used primarily for educational training and academic research purposes as specified in NRC regulation 10 CFR 171.11(a)(2). To receive the fee exemption in future years, you must continue to certify that you meet the exemption criteria.
