SUBJECT:

SAN ONOFRE NUCLEAR GENERATING STATION, UNITS 2 AND 3 -

SECURITY IN-OFFICE INSPECTION REPORT 05000361/2007404;

5000362/2007404; OFFICE OF INVESTIGATION REPORT 4-2006-039; AND

NOTICE OF VIOLATION

Dear Mr. Rosenblum:

This refers to the in-office inspection conducted to review the results of NRC's Office of

Investigation Report 4-206-0039 regarding your San Onofre Nuclear Generating Station.

Specifically, the purpose of the inspection and investigation was to review the circumstances

related to a security event that occurred between March 18 and 27, 2006. The enclosed report

presents the results of this inspection, which were discussed on June 18, 2007, with B. Katz,

Vice President, Nuclear Oversight and Regulatory Affairs, and other members of your staff.

The inspection examined activities conducted under your license as they relate to security and

compliance with the Commission's rules and regulations and with the conditions of your license.

Based on the results of the inspection and investigation, the NRC has determined that two

violations of NRC requirements were identified. The NRC has also concluded that the findings

were both NRC identified. The violations were evaluated in accordance with the NRC

Enforcement Policy, which can be found on the NRC's Web site at www.nrc.gov, select About

NRC, then How we regulate, and Enforcement. The first violation is being cited in the

enclosed Notice of Violation (Notice). The security significance of this violation would normally

be minor; however, the violation was categorized at Severity Level IV because willfulness was

involved. In addition, this violation is being cited in the Notice because willfulness was involved

on the part of a licensee official and it was not licensee-identified (See Section VI.A.1.d of the

NRC Enforcement Policy).

The second violation has been categorized at Severity Level IV because it could not be

evaluated under the significance determination process. The second violation involved your

staffs failure to provide accurate information related to the circumstances involved with the first

violation. The NRC is treating this second violation as a noncited violation consistent with

Section VI.A.1 of the NRC Enforcement Policy because of the very low security significance of

the violation and because it was entered into your corrective action program. If you contest this

noncited violation, you should provide a response within 30 days of the date of this inspection

report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN.: Document

Control Desk, Washington DC 20555-0001; with copies to the Regional Administrator, Region

IV; the Director, Office of Enforcement, US Nuclear Regulatory Commission, Washington, DC

20555-0001; and the NRC Resident Inspector at the San Onofre Nuclear Generating Station.

You are required to respond to the Notice in this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. The NRC will use your

response, in part, to determine whether further enforcement action is necessary to ensure

compliance with regulatory requirements.

In accordance with 10 CFR 2.390 of the NRCs "Rules of Practice," a copy of this letter will be

available electronically for public inspection in the NRC Public document Room or from the

Publicly Available Records (PARS) component of NRCs document system, ADAMS. ADAMS

is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public

Electronic Reading Room). However, because of the security-related concerns contained in the

enclosure, and in accordance with 10 CFR 2.390, a copy of this letters enclosure will not be

available for public inspection.

In accordance with 10 CFR 2390(b)(1)(ii), the NRC is waiving the affidavit requirements for your

response, if any. This practice will ensure that your response will not be made available

electronically for public inspection in the NRC Public document Room or from the NRC's

document system, ADAMS. If Safeguards Information is necessary to provide an acceptable

response, please provide the level of protection described in 10 CFR 73.21. Otherwise, mark

your entire response "Security-Related Information-Withhold Under 10 CFR 2.390" and follow

the instructions for withholding in 10 CFR 2.390(b)(1).
