Reference (a) is the Nuclear Energy Institute (NEI) response on a petition fur rulemding on 10 CFR Part 50, submitted by the Project an Government Oversight and Union of Conwmed Scientists.
Constellation Energy Generation Group, Parent Corporation for three naclear licensees, agrees with NEl's comments on the petition.
Specifically, we a p e that defense against a threat greater than the design basis threat would require supplementation by local, state, and federal entities.
We also agree with NET that the inter-relation of nuclear plant defense and lacat, state, and federal entities appears to be axleq~naely addressed in the Nuclw Regulatory Comissian and Depament of Homeland Security deveiopent of wmprehensive review programs and integrated response planning efforts. This coordinated effort is described in 72 Federal Register i2705, which imp1emerrtt.d 10 CFR Part 73 and makes a change to 10 CFR Part 50 unnecessary.
