NRC RECEIPT OF DUKE POWER COMPANY LLCS RESPONSE TO NRC GENERIC LETTER 2006-03, POTENTIALLY NONCONFORMING HEMYC AND MT FIRE BARRIER CONFIGURATIONS, FOR MCGUIRE NUCLEAR STATION, UNITS 1 AND 2 (TAC NOS. MD1596 & MD1597)
Dear Mr. Peterson:
The Nuclear Regulatory Commission (NRC) acknowledges the receipt of your response dated June 7, 2006, to Generic Letter 2006-003, Potentially Nonconforming Hemyc and MT Fire Barrier Configurations. Under oath or affirmation, your response states that your nuclear power plant relies on the Hemyc fire barrier system, and you have submitted documentation that you plan to disposition any nonconforming conditions in accordance with Title 10 of the Code of Federal Regulations, Part 50, Section 50.48(c) process. Also, compensatory measures will remain in place until nonconforming conditions have been resolved and those resolutions are acceptable to the NRC.
The use of fire resistive cables, in-lieu of 3-hour fire barriers that separate redundant safe shutdown trains located within the same fire area, is in accordance with current NRC guidance.
The basis for stating that these fire resistive cables have been designed and installed in accordance with NRC guidance should be maintained on site, and will be subject to inspection during the normal NRC inspection process.
