CLARIFICATION OF THE NUCLEAR REGULATORY COMMISSION STAFFS LETTER ACKNOWLEDGING THE RECEIPT OF EXELON GENERATION COMPANYS RESPONSES TO GENERIC LETTER 2006-03, POTENTIALLY NONCONFORMING HEMYC AND MT FIRE BARRIER CONFIGURATIONS, FOR DRESDEN NUCLEAR PLANT, UNITS 2 AND 3, AND LASALLE COUNTY STATION, UNITS 1 AND 2 (TAC NOS. MD1575, MD1576, MD1592 AND MD1593)

On May 7, 2007, the NRC staff held a conference call with Mr. David Gullott and other members of your staff to clarify the NRC staffs conclusions in letters dated September 18, and November 27, 2006, documenting the receipt of Exelon Generation Company, LLCs (the licensees), responses to Generic Letter (GL) 2006-03, Potentially Nonconforming Hemyc and MT Fire barrier Configurations, for the Dresden Nuclear Power Station, Units 2 and 3 (Dresden), and LaSalle County Station, Units 1 and 2 (LaSalle) (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML063000065, and ML062300114, respectively). These letters documented the completion of the NRC staffs review of the licensees GL 2006-03 responses and concluded that the 1-or 3-hour fire barrier material that separates safe shutdown trains is located within the same fire area, and is designed and installed in accordance with the current NRC guidance. The licensee requested clarification of the NRC staffs conclusion because certain electrical raceway fire barrier system (ERFBS) configurations at Dresden and LaSalle, although installed in configurations that are acceptable to the NRC staff, would not meet a strict definition of designed and installed in accordance with current NRC guidance.

The NRC staff clarified in the conference call that for the purpose of closing the review of GL 2006-03 responses, licensees meet the current NRC guidance if the ERFBS has either been designed, installed, or evaluated per GL 86-10, Supplement 1, Implementation of Fire Protection Requirements, or had previously been reviewed and approved by the NRC staff in a safety evaluation report or an exemption, provided that the bases for the acceptance of those actions have not changed. The licensee verbally confirmed that the subject ERFBS configurations have not changed since the NRC staffs review and acceptance.

The licensee confirmed during the conference call that, for Dresden, the 3M ERFBS configurations not bounded by fire tests were evaluated under GL 86-10, Supplement 1, and found to be acceptable by the licensee. The NRC staff stated that the documentation for these evaluations is subject to NRC review during inspections and must be available on site.

For LaSalle, NUREG-0519, Safety Evaluation Report Related to the Operation of LaSalle County Station Units 1 and 2, Supplement 2, dated February 1982 (ADAMS Accession

C. Crane No. 8203030262), documented the NRC staffs acceptance of the installed Kaowool configurations that the licensee described in a letter dated November 3, 1981 (ADAMS Accession No. 8111060281).
