WITHDRAWAL OF ELECTRIC POWER RESEARCH INSTITUTE (EPRI)

TOPICAL REPORT (TR)-1002865, REVISION 0, REACTIVITY INITIATED ACCIDENTS [(RIA)]: BASES FOR RIA FUEL ROD FAILURES AND CORE COOLABILITY CRITERIA (TAC NO. MD0705)

Dear Mr. Riley:

By letter dated April 22, 2002, as supplemented by letters dated June 12, 2002, and June 13, 2006, the Nuclear Energy Institute (NEI) submitted for U.S. Nuclear Regulatory Commission (NRC) staff review an Electric Power Research Institute (EPRI) TR-1002865, Revision 0, Reactivity Initiated Accidents: Bases for RIA Fuel Rod Failures and Core Coolability Criteria.

Subsequently, by letter dated May 9, 2007, the NEI requested withdrawal of its TR from NRC review in light of the various discussions held with NRC staff and the recent release by the Office of Nuclear Reactor Regulation of interim acceptance criteria for RIA as a proposed revision to NUREG-0800. In its withdrawal letter, the NEI also indicated that it planned to resubmit EPRI TR -1002865 in early 2008. This resubmittal would revise the contents of the TR for consideration by the NRC as the basis for the final RIA acceptance criteria.

Based upon your request, the NRC staff will terminate its review of EPRI TR-1002865, Revision 0. The review schedule milestones will be discussed and agreed upon in a telephone conference between your staff and the NRC staff once the TR is resubmitted.

By letter dated January 3, 2005, a fee waiver was granted for the NRCs review in accordance with the applicable provisions of Title 10 of the Code of Federal Regulations, Section 170.11.

Since a fee waiver was approved to support the NRCs review of this TR, the correspondence which transmits the revised TR should reference this memorandum.
