WOLF CREEK GENERATING STATION - COMPLETION OF PRE-APPLICATION REVIEW OF MAIN STEAM AND FEEDWATER ISOLATION SYSTEM CONTROLS REPLACEMENT (TAC NOS. MD3209 AND MD3561)

Dear Mr. Muench:

By letter dated August 2, 2006 (ET 06-0032), the Wolf Creek Nuclear Operating Corporation (the licensee) requested a pre-application review of the plans to replace the main steam and feedwater isolation system (MSFIS) controls during the refueling outage scheduled for the spring of 2008. In that letter, it was mentioned that your staff met with the Nuclear Regulatory Commission (NRC) staff on June 28, 2006, regarding these plans to submit a license amendment request (LAR) to use field programmable gate array (FPGA) technology in the replacement MSFIS controls at Wolf Creek Generating Station. The NRC meeting summary was issued July 12, 2006. The NRC staff issued the fee bearing TAC MD3209 for this pre-application review.

Since this application of FPGA technology would be unique at this time, being the first application of the technology at a nuclear power plant in the United States, the licensee also requested that the NRC approve a fee exemption for that portion of the NRC amendment review that would have value to the NRC developing generic review guidance on the application of this technology at nuclear power plants. In response to this request, the NRC issued a partial fee exemption in its letter dated November 6, 2006, and assigned the non-fee bearing TAC MD3561 for this review.

Since the letter of August 2, 2006, your staff and the NRC staff have had several discussions in conference calls, which have lead up to your LAR application that was submitted to the NRC on March 14, 2007 (ET 07-0004). The following fee bearing TAC numbers were assigned for the review of this application: (1) MD4839, review of the MSFIS digital upgrade, (2) MD4840, review of the changes to Technical Specifications (TSs) for the replacement of the main steam isolation valves (MSIVs) and main feedwater isolation valves (MFIVs), and (3) MD5266, review of the TS changes associated with Technical Specification Task Force (TSTF) traveler 491 (TSTF-491), Revision 2, Removal of Main Steam and Feedwater Valve Isolation Times.

At this time, the NRC staff is reviewing the LAR submittal to determine if sufficient information has been provided to allow the NRC to begin its review. Because the LAR has been submitted, the pre-application review has been completed and, therefore, this letter closes out the fee
