Dear Mr. Feeney,

Thank you for your letter requesting review of the final documents provided by the licensee concerning Indian Point Energy Center (IPEC) new alert and notification system (ANS) design as described in the January 5, 2007 report and the additional information provided, to DHS/FEMA at a meeting with your office, the licensee and the NRC on March 8,, 2007. These documents together form the Alert and Notification System Design Report of record. (See Attachment A to this letter for an inventory of the information that was provided on March 8, 2007.) Please see the attached memorandum from Craig Conklin, REP Program HQ (Attachment B) indicating DHS/FEMA approval of the design. Per 44 CFR 350.14, any "significant changes" to the design must receive DHS/FEMA regional prior review and acceptance before they can be implemented by IPEC. Following these procedures should keep the project on track and timely.

Final DHS/FEMA acceptance of the new IPEC siren system will be predicated on adequate documentation of the final system components and configuration including operating procedures, results of commissioning testing, software quality assurance (QA) and configuration management, siren system testing frequency; procedures and methods, alert and notification system performance indicators, system interfaces, and the preventive maintenance program. Any new backup notification procedures also need to be described, including testing results.

This information should be included in a. consolidated design report and submitted to DHS/FEMA as soon as possible after the new siren system is declared operational.

These actions will be necessary to provide reasonable assurance that the proposed IPEC'9 alert and notification system will continue to meet the design objectives described in'the' design report throughout its operating lifetime and that the.proposed new backup alert and notification method adheres to the applicable guidance of NUREG-0654/FEMA-REP-1,. Rev. 1, Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants and FEMA-REP-10, Guide for the Evaluation ofAlert and Notification Systems for Nuclear Power Plants.

As noted in the memorandum from DHS HQ REP Program Branch, the old alert and notification system must remain operational to ensure that sufficient ANS coverage is maintained. Once the DHS/FEMA REP Program has provided final approval of the new IPEC ANS, the old system may be dismantled.

Analysis of the Indian Point Energy Center Alert and Notification System Design Report Based on the original Indian Point Energy Center ([PEC) Alert and Notification System (ANS)

Design Report, dated January 5, 2007, as well as the additional information provided by Entergy during our meeting of March 8, 2007, the IPEC ANS Design Report is hereby approved.

However, final acceptance of the IPEC ANS is contingent upon DHS approval of the system test results, as outlined in FEMA REP-0, "Guide for the Evaluation of Alert and Notification Systems for Nuclear Power Plants", dated November, 1985, and NUREG-0654/FEMA-REP-1 Rev 1, "Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants", reprinted March, 1987. The final system test results must indicate that the number of sirens tested for meeting the acceptable decibel levels above background was based on a statistical sampling methodology approved by DHS. A description of the sampling methodology used must also be provided with the final system test results.

During system testing and the DHS approval process, the old ANS must remain operational to ensure sufficient ANS coverage is maintained. Once DHS has provided final approval of the new IPEC ANS, the old system is no longer required to remain operational.

Please convey the contents of this memorandum to the appropriate Entergy and State of New York management representatives and request that they provide you with the necessary information and requirements.
