On April 11, 2007, at 3:30 PM, this Board will convene a conference call with counsel to the parties to discuss matters relating to case scheduling and management. See 10 C.F.R. § 2.332(a) - (c). The parties should be prepared to discuss the preparation of a scheduling order that includes the processes in 10 C.F.R. § 2.1207 and that is consistent with the model milestones for Subpart L hearings provided in 10 C.F.R. Part 2, Appendix B (II). In particular, the Board will solicit the parties views on the following topics: (1) the status of the mandatory disclosure process (10 C.F.R. §§ 2.336, 2.1203); (2) what plans, if any, Citizens have for filing new or amended contentions based upon the Safety Evaluation Report; (3) what plans, if any, the parties have for filing motions for summary disposition; (4) the parties estimate regarding the length of time necessary for an evidentiary hearing on the currently admitted contention; (5) whether the parties anticipate any portion of the evidentiary hearing will require discussion of proprietary information; (6) New Jerseys intention to participate as an interested State (10 C.F.R. § 2.315(c)); (7) whether settlement is conceivable; (8) if settlement is not conceivable, whether the parties can reach agreement on any underlying factual or legal issue; (9) whether 1

the parties are aware of any other matters that may impact the scheduling order; and (10) any other matters that counsel may wish to bring to the Boards attention.

No later than 5:00 PM on April 5, counsel should notify Libby Perch - who is a member of the Licensing Board Panels administrative staff, and who may be reached at 301-415-6094 -

of (1) the name of counsel who will be speaking on behalf of the party, and (2) the number of separate locations from which you and any colleagues or associates will be calling, so that she may reserve an appropriate number of phone lines. Ms. Perch will provide instructions for participating in the call, including the telephone number and pass code. To assure that the conference call commences promptly, all participants should access the telephone number a few minutes before the conference is scheduled to begin.

The conference call will be stenographically transcribed. After the call, the Board will issue an appropriate Scheduling and Case Management Order.
