ST. LUCIE NUCLEAR PLANT - NRC INSPECTION REPORT NO.

05000335,389/2007401

Dear Mr. Stall:

This refers to the Nuclear Regulatory Commissions (NRC) inspection completed on March 2, 2006, at Florida Power and Light Companys (FPL) St. Lucie Nuclear Plant. A Special Inspection Team (SIT) was established to examine activities conducted under your license as they relate to safety and compliance with the Commissions rules and regulations and with the conditions of your license. The results of the SIT inspection, which included an Unresolved Item (URI) at St. Lucie, were forwarded to you in NRC inspection report 50-335, 389/2006009 dated May 8, 2006. This report documents findings as a result of additional in-office inspection, that were discussed at an exit meeting on March 5, 2007, with Mr. Terry Patterson, Site Licensing Manager and other members of your staff.

This inspection examined activities conducted under your licenses as they relate to safety and compliance with the Commissions rules and regulations and with the conditions of your license.

Within these areas, the inspection consisted of selected examination of procedures and representative records, observations of activities, and interviews with personnel.

Based on the results of this inspection, one apparent violation was identified and is being considered for escalated enforcement action in accordance with the NRC Enforcement Policy.

The details associated with the apparent violation are described in the enclosed inspection report. The current Enforcement Policy is located on the NRCs Web site at www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html.

Before the NRC makes its enforcement decision, we are providing you an opportunity to either:

(1) respond to the apparent violation addressed in this letter within 30 days of the date of this letter or (2) request a pre-decisional enforcement conference. If a conference is held, it will not be open for public observation. Please contact Mr. Joel Munday, within 10 business days of the date of your receipt of this letter to notify us of your intentions.

FPL 2 OFFICIAL USE ONLY - SECURITY-RELATED INFORMATION If you choose to provide a written response, it should clearly be marked as a Response to An (Apparent Violation) EA-06-092" and should include: (1) the reason for the apparent violation, or, if contested, the basis for disputing the apparent violation; (2) the corrective steps that have been taken and the results achieved; (3) the corrective steps that will be taken to avoid further violations; and (4) the date when full compliance will be achieved. In presenting your corrective actions, you should be aware that the promptness and comprehensiveness of your actions will be considered in assessing any civil penalty for the apparent violation. Your response should be submitted under oath or affirmation and it may reference or include previously docketed correspondence, if the correspondence adequately addresses the required response. If an adequate response is not received within the time specified or an extension of time has not been granted by the NRC, the NRC will proceed with its enforcement decision.

Since the NRC has not made a final determination in this matter, no Notice of Violation is being issued for this inspection finding at this time. In addition, please be advised that the number and characterization of the apparent violations described in this inspection report may change as a result of further NRC review. In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.

gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related concerns contained in the enclosure, and in accordance with 10 CFR 2.390 a copy of the enclosure will not be available for public inspection.

In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response, if any. This practice will ensure that your response will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system, ADAMS. If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21. Otherwise, mark your entire response Security Related Information-Withhold Under 10 CFR 2.390" and follow the instructions for withholding in 10 CFR 2.390 (b)(1).
