CLOSURE OF NRC=S REVIEW OF FIRSTENERGY NUCLEAR OPERATING COMPANY=S RESPONSE TO GENERIC LETTER 2006-03, APOTENTIALLY NONCONFORMING HEMYC AND MT FIRE BARRIER CONFIGURATIONS@

Dear Mr. Leidich:

The Nuclear Regulatory Commission (NRC) acknowledges the receipt of FirstEnergy Nuclear Operating Company=s (FENOC=s) responses to Generic Letter 2006-03, APotentially Nonconforming Hemyc and MT Fire Barrier Configurations,@ for Beaver Valley Power Station, Units 1 and 2; Davis-Besse Nuclear Power Station, Unit No. 1; and Perry Nuclear Power Plant, Unit No. 1, in letters dated June 8, 2006, and February 1, 2007. Under oath or affirmation, Mr. Danny L. Pace stated that the FENOC nuclear power plant fleet does not rely on either the Hemyc or MT fire barrier system. You have submitted documentation under oath or affirmation that other 1 or 3-hour fire barriers that separate redundant safe shutdown trains located within the same fire areas at each FENOC unit have been designed and installed in accordance with current NRC guidance.

Based on your June 8, 2006, and February 1, 2007, responses, the bases for stating that these other fire barriers have been designed and installed in accordance with NRC guidance should be maintained on site for each unit, and will be subject to inspection during the normal NRC inspection process. Accordingly, the NRC staff=s review of FENOC=s response is complete and it will close TACs MD1548, MD1549, MD1572, and MD1615.
