PRELIMINARY INFORMATION - NOT FOR PUBLIC DISCLOSURE UNTIL VERIFICATION THAT LICENSEE HAS RECEIVED ACTION March 8, 2007 EN-07-013 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Constellation Nuclear (EA-07-001)

Nine Mile Point, Unit 1 Docket No. 05000220

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White significance determination process finding will be issued on or around March 13, 2007, to Constellation Nuclear, as a result of inspections at Nine Mile Point, Unit 1. This White finding, an issue of low to moderate safety significance which may require additional U.S. Nuclear Regulatory Commission inspection, involved the Licensed Operator Requalification Training Program.

Specifically, the annual dynamic simulator exam integrity was unintentionally compromised at Unit 1 for calendar years 2005 and 2006, when the process used to select and validate the simulator exam scenarios resulted in the licensed operators being knowledgeable of a significant portion of the exam prior to its administration. When this concern was identified in 2006, the licensee promptly re-administered valid exams. However, the 2005 exams were not corrected prior to returning licensed operators to normal duties.

A Notice of Violation is included based on a violation of 10 CFR 55.49, which requires, in part, that licensees shall not engage in any activity that compromises the integrity of any application, test, or examination. Specifically, for calendar years 2005 and 2006, the process used by the licensee to select and validate simulator exam scenarios compromised the exams integrity.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Final Significance Determination March 13, 2007 Telephone Notification of Licensee March 13, 2007 The State of New York will be notified.
