SUMMARY

OF FEBRUARY 16, 2007, MEETING WITH EXELON GENERATION COMPANY, LLC, ON PRE-SUBMITTAL OF LICENSING AMENDMENT FOR AN ALTERNATE SOURCE TERM FOR PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3 (TAC NOS. MD4429 AND MD4430)

On February, 16, 2007, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Exelon Generation Company, LLC (Exelon, the licensee) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to hold a pre-submittal discussion regarding the Peach Bottom Atomic Power Station, Units 2 and 3 (Peach Bottom) Alternate Source Term (AST) licensing amendment. A list of attendees is provided as Enclosure 1.

The licensee presented information (See Agencywide Documents Access and Management System (ADAMS) Accession No. ML07057044) detailing the current approach and key elements of the AST submittal. During the presentation, Exelon representatives noted that the AST submittal would include an amendment to remove the filter elements associated with the standby gas treatment system to preclude filter clogging concerns. The technical specifications (TS) would also be revised to allow a 30-minute delay in actuation of the main control room essential ventilation (MCREV) initiation time.

NRC staff commented that the justifications for these changes would need to be fully explained in the submittal as well as any deviations from the guidance contained in Regulatory Guide 1.152. NRC staff stressed that the new Peach Bottom submittal should incorporate lessons learned from the previous Exelon AST amendments including the Oyster Creek Nuclear Generating Station application currently under NRC review. In particular, standby liquid control issues should be adequately addressed and the licensing basis validated. The NRC staff also asked that a detailed site location schematic be included in the submittal to aide in the review.

Exelon representatives stated that the Peach Bottom AST submittal preparation was on-track for submission in May of 2007. Exelon will be requesting that the final approval be completed in time to support a planned refueling outage in September 2008. Exelon representatives suggested that planned, periodic phone conferences be scheduled in order to facilitate completion of the NRC review and final approval by the September 2008 time frame.

In subsequent discussions with Exelon, the NRC staff suggested that TS changes imbedded in an AST submittal may be problematic and could result in non-acceptance of the application if any of the proposed TS changes were not fully justified or include adequate precedence.
