ST. LUCIE NUCLEAR PLANT, UNIT NOS. 1 AND 2 - REINITIATION OF CONSULTATION (TAC NOS. MC7266 AND MC7267)
Dear Mr. Stall:
By letter dated February 1, 2007, Florida Power and Light Company informed the U.S. Nuclear Regulatory Commission (NRC) that the incidental take limit for sea turtles at the St. Lucie Nuclear Power Plant was exceeded in 2006. A total of 662 green turtles (Chelonia mydas) and loggerhead turtles (Caretta caretta) was entrained in 2006. Because 29 of the 662 turtles were injured or killed, the 1 percent limit was exceeded, which requires the NRC to reinitiate a formal consultation with the National Marine Fisheries Service (NMFS) according to Section 7 of the Endangered Species Act. Because NRC and NMFS are currently in consultation regarding the smalltooth sawfish (Pristis pectinata), the consultation regarding sea turtles will be combined with the ongoing consultation, as stated in the enclosed letter from NMFS dated December 19, 2006. NMFS will conclude the consultation with one comprehensive biological opinion to address all species under their jurisdiction, including the smalltooth sawfish and sea turtles.
The NMFS letter provides a draft Reasonable and Prudent Measures (RPM) and Terms and Conditions regarding the smalltooth sawfish. The term and condition for implementing RPM No. 4 is premised on the scheduled outages in 2007 to allow a survey of the intake pipe in the first outage, followed by any necessary debris removal and structural repair in the second outage, as appropriate.
