July 19, 2005 Mr. J. A. Stall Senior Vice President, Nuclear and Chief Nuclear Officer Florida Power and Light Company P.O. Box 14000 Juno Beach, Florida 33408-0420
SUBJECT:
ST. LUCIE NUCLEAR PLANT, UNITS 1 AND 2 REINITIATION OF CONSULTATION UNDER SECTION 7 OF THE ENDANGERED SPECIES ACT (TAC NOS. MC7266 AND MC7267)
Dear Mr. Stall:
On May 16, 2005, the St. Lucie Nuclear Power Plant captured a smalltooth sawfish, Pristis pectinata, in the plants intake canal. The specimen was taken in a tangle net used to capture sea turtles where it was retrieved and promptly returned to the ocean. Florida Power and Light (FPL) representatives contacted the National Marine Fisheries Service (NMFS) to report the take and provided additional data, as requested.
The smalltooth sawfish was listed in April 2003 as endangered under the Endangered Species Act of 1973, as amended. Therefore, following discussions with NMFS, the U. S. Nuclear Regulatory Commission (NRC) staff requested reinitiation of formal Section 7 consultation in a letter dated July 8, 2005. This document can be found in the NRC Agencywide Documents Access and Management System at ML051920400.
The NRC staff plans to prepare a biological assessment (BA) for this species and submit it before the end of this calendar year. In a telephone conversation on July 5, 2005, FPL agreed to provide the NRC staff with records of endangered sea turtle captures, details of recent dredging activities in the intake canal, and information on research and conservation efforts.
This information will be included in the BA. We will contact the FPL staff if additional information is needed.
If you have any questions, please contact me at (301) 415-3974.
Sincerely,
/RA/
