Nuclear Regulatory Commission Attn: Document Control Desk Washington, D.C. 20555 Re: St. Lucie Units 1 and 2 Docket Nos. 50-335 and 50-389 Notification That Turtle Incidental Take Exceeded At the conclusion of 2006 the St Lucie Plant determined that the Incidental Take Statement, as defined in the National Marine Fisheries Service (NMFS) Biological Opinion dated May 4, 2001 was exceeded. In 2006 a total of 662 green turtles (Chelonia mydas), and loggerhead turtles (Caretta caretta) were entrained in the St. Lucie Plant intake cooling system. The total incidental take for 2006 was 29 sea turtles, and exceeds the 1% limit allowed by the Biological Opinion.

The total number of takes consisted of seven sea turtles that sustained injuries, and 22 mortalities deemed causal to plant operations. The injured sea turtles were sent to rehabilitation. The mortalities were reported to NRC on February 14, 2006, in FPL letter L-2006-046 and on November 21, 2006, in FPL letter, L-2006-254.

This notification is required by St. Lucie Plant administrative procedure AP 0005762, "Plant Guide to Routine/Non-Routine Environmental Reporting and Significant Events." Please contact Ken Frehafer at (772) 467-7748 if there are any questions on this matter.
