Letter dated December 20, 2006 from Duke to the Nuclear Regulatory Commission (NRC) initiating an appeal of the Final Significance Determination for a White Finding related to potential SSF flooding In Reference 1, Duke Power Company LLC d/b/a Duke Energy Carolinas, LLC (Duke) initiated an appeal of the subject White Finding in accordance with Attachment 0609.02 of the NRC Inspection Manual Chapter 0609. In that letter, Duke made reference to a contractor performing an evaluation of the seismic risk component of seismically induced floods.

The contractor, ARES Engineering, provided Duke with the draft study report on January 5, 2007, that documented the conclusions of their comprehensive and detailed evaluation.

A copy of the draft report was submitted to the NRC on January 11, 2007. The final ARES study report was approved and issued on January 29, 2007. The attachment to this letter contains the ARES study report in its entirety.

Duke respectfully requests that the NRC consider this seismic fragility information in evaluating the aforementioned appeal request, as it represents the most accurate and current data available. Duke further requests that the ARES report be withheld from public disclosure in accordance with the provisions of 10CFR50 2.390 due to its sensitive and proprietary nature.
