ogc version is not accurate in one respect: NJ did not participate in the 1/16 conf call; they were invited and indicated they would, but did not call in. rich conte circled back with them immediately thereafter.

I would like to set up a conference call this afternoon, Wednesday, January 31, after Randy returns from Pilgrim. The purpose of the phone call is to reach alignment on the NRC response to the State of NJ.

Attached is the version of the letter that incorporates RI input, and the version of the letter based on OCG comments.

Please let me know if you are available for a 3:00 p.m. phone call?

Attached is a proposed revision to the letter based on Mitzi's input. She questioned whether "well-communicated" should be revised. She questioned Whether the last sentence of your paragraph should be deleted. She asked whether the State participated in the conference call and whether the postponement of the call prevented the State from raising issues.

Please let me know what revisions, if any, I should make to the attached draft.

Here's a rewrite.

Your letter commented about the rescheduling of a January 11, 2007 conference call by NRC Region I. The call was a brief update from the previously held inspection exit meeting and its rescheduling and content were well-communicated to the State. The subject call occurred on January 16 and the report was issued January 17 (ADAMS #ML070170396). The NRC Regional staff communicated extensively with the State throughout that inspection.

OYSTER CREEK DRYWELL CORROSION - EXPERT REVIEW

Dear Ms. Lipoti:

We have received your letter dated January 17, 2007. Thank you for informing us of your intention to hire an independent expert in the field of corrosion mechanisms to review and comment on the technical report prepared by AmerGen Energy Company, Inc. (AmerGen),

which set fourth AmerGen's basis for concluding that Oyster Creek Nuclear Generating Station could restart from the October 2006 outage and operate until the next refueling outage.

During the Advisory Committee on Reactor Safeguards (ACRS) License Renewal Subcommittee meeting on January 18, 2007, the ACRS members held extensive discussions with AmerGen and the U.S. Nuclear Regulatory Commission (NRC) staff concerning water in the drywell floor trenches and its effect on corrosion of the drywell shell in the embedded area.

Since you were unable to attend the meeting, we have enclosed the ACRS meeting transcript for your information.

Your letter noted the rescheduling of a January 11, 2007, conference call by NRC Region I.

The call was a brief update on the previously held inspection exit meeting. As you know, the State was given advance notice of the rescheduling of the call and its content. The call with AmerGen was held on January 16, 2007, and after the State unexpectedly did not join the teleconference, Region I contacted your staff promptly to provide a debrief. The inspection report, RI 05000219/2006013, was issued on January 17, 2007 (ADAMS ML070170396). We believe the NRC Regional staff communicated extensively with the State throughout that inspection.
