Dear Mr. Norris:

On August 31, 2006, Constellation Energy submitted a proposed change to the Nine Mile Point Site Emergency Plan to eliminate the existing requirement for augmenting on-shift Emergency Response Organization (ERO) staff within 30 minutes. If approved, this revision would result in changing the required response time of certain ERO staff from 30 to 60 minutes during regular business hours. Staff of the New York State Emergency Management Office, New York State Departments of Health and Public Service, and New York State Energy Research and Development Authority have reviewed the proposal and held related discussions with representatives of Nine Mile Point's emergency response organization.

We recognize that the proposed change is within the staffing requirements set forth in NRC NUREG-0654. However, the NRC should be aware that New York's emergency response agencies have expressed concern to the nuclear power plant operators on several occasions regarding the need for information early in an event, particularly in a fast moving scenario which either starts at or quickly escalates to an alert or higher (the level at which the State would begin staffing its emergency operations center).

Some of the plant licensees have suggested that the State's need for information regarding what is occurring at the plant should not unnecessarily interfere with the control room staff's efforts to respond to the event. We certainly agree and would judiciously limit the time taken to ascertain the required information. However, the initial notifications generally come from the control room and until other parts of the plant's ERO are activated, there is no place else for the State to turn. We ask that the NRC encourage the plant operators to incorporate a continuous communication capability for interacting with the State until the regular communication lines are activated. We will continue to work with Nine Mile Point and the other nuclear power stations in New York to increase the efficiency and effectiveness of emergency response and communications.
