Dear Jill:

This responds to your email of January 12,2007, in which you requested my comments on a proposed letter. Since the letter does not directly relate to NRC inspection activities, but instead relates more broadly to license renewal, I will not be providing comments.

Earlier, during the Fall 2006 NRC inspection at Oyster Creek, I had provided you comments to explain NRC inspection activities, technical assessments, and regulatory conclusions related to the operability of Oyster Creek's primary containment for the current operating cycle. Whereas I had judged back then. that it was within my role to provide comments, I do not believe it is appropriate in the current, different situation. I hope you understand.

As you are likely aware, I need to provide your e-mail to me, along with this response, to appropriate NRC staff for consideration of inclusion into the Oyster Creek License Renewal Hearing File.

I want to go on record with a letter saying that we are hiring outside experts to help us with looking at the issue of corrosion of the OC drywell. As you know, we thought the NRC was thorough in investigating the issue before restart, but we reserved judgement with regard to license renewal.

I've drafted a letter. It is attached. I wanted to send it prior to the ACRS subcommittee meeting.

Last time I drafted a letter, you looked at it from the point of view of the sensitivity of NRC to certain words, phrases, etc.

Can you just give me an honest read of the attached letter? I don't want to raise eyebrows, and I just want to focus on the fact that we are hiring an outside expert. I'm worried that I may have said something unintentionally that could be construed as criticizing NRC.
