WITHDRAWAL OF AMENDMENT REQUESTS TO FACILITY LICENSE NO. R-95 -- RHODE ISLAND NUCLEAR SCIENCE CENTER RESEARCH REACTOR (TAC NOS. MC1459, MC2878, MC2879 and MD2910)
Dear Dr. Tehan:
By letters dated November 20, 2003, March 5 and April 5, 2004, and supplemented on October 26 and November 15, 2004, you applied for an amendment to Facility Operating License No. R-95 for the RINSC Research Reactor. The proposed Technical Specification (TS) changes involved fuel and beryllium reflector surveillance requirements, Director minimum qualification requirements, staff requirements during operation, and the Nuclear and Radiation Safety Committee (NRSC) minimum membership and voting requirements. With letters on August 16, 2004, you requested that the first two proposed changes be separated from the remaining changes and issued as a separate amendment. The first two changes were issued on December 28, 2004, as Amendment No. 29 and the remaining proposed TS changes were subject to a request for additional information and clarification (RAI), which was sent December 15, 2004. You have not responded to that RAI. Later, in your letter dated March 25, 2005, you requested an additional proposed change to the minimum NRSC membership requirements. Subsequently, you have determined that you would not pursue these issues; and, in a telephone conversation on January 11, 2007 between you and I, you explained that you planned to withdraw the amendment request for all of the outstanding proposed changes.
Unless you notify the NRC that this information is incorrect within 15 business days of the date of this letter, we will consider the application to be withdrawn and close this action.
