AUDIT OF NRCS DRUG TESTING PROGRAM (OIG-05-A-05)

REFERENCE:

DIRECTOR, OFFICE OF ADMINISTRATION, MEMORANDUM DATED NOVEMBER 30, 2006 Attached is the Office of the Inspector General (OIG) analysis and status of the recommendations as discussed in the agencys response dated November 30, 2006.

Based on this response, recommendations 4, 5, and 12 remain resolved.

Recommendations 1, 2, 3, 6, 7, 8, 9, 10, and 11 were previously closed. Please provide an updated status of resolved recommendations by March 31, 2007.

Audit Report Audit of NRCs Drug Testing Program OIG-05-A-05 Status of Recommendations Recommendation 4: Revise the categories of testing-designated positions to include computer system administrators and individuals engaged in law enforcement activities who are authorized to carry weapons.

Response dated November 30, 2006:

On September 29, 2006, the Commission approved the staff=s recommendation to designate all the U.S. Nuclear Regulatory Commission (NRC) positions as sensitive and include all NRC employees in its random drug testing pool.

The NRC Drug-Free Workplace Plan (Plan) was revised to reflect this change and was forwarded to the Department of Health and Human Services (HHS) for review and approval on September 29, 2006. HHS provided comments on our Plan on November 1, 2006. ADM anticipates resolving HHS comments by December 15, 2006, and will consider this recommendation closed upon HHS approval and our implementation of the revised Plan.

OIG Analysis:

The corrective action addresses the intent of this recommendation. This recommendation will be closed when OIG receives verification that ADM has implemented the revised NRC Drug-Free Workplace Plan as described above.

Status:

Resolved.

Audit Report Audit of NRCs Drug Testing Program OIG-05-A-05 Status of Recommendations Recommendation 5: Re-evaluate categories of testing designated positions and continue to do so biennially.

Response dated November 30, 2006:

Since the Commission has approved the staff=s recommendation to designate all NRC positions as sensitive and include all NRC employees in its random drug testing pool, re-evaluating categories of testing designated positions will not be necessary. ADM will consider this recommendation closed upon HHS approval and our implementation of our revised Plan.

OIG Analysis:

The corrective action addresses the intent of this recommendation. This recommendation will be closed when OIG receives verification that ADM has implemented the revised NRC Drug-Free Workplace Plan as described above.

Status:

Resolved.

Audit Report Audit of NRCs Drug Testing Program OIG-05-A-05 Status of Recommendations Recommendation 12:

Update the Management Directive System to include the drug testing policy and procedures that employees are expected to follow.

Response dated November 30, 2006:

ADM anticipates developing a new Management Directive (MD) following receipt of HHS approval of the Plan. The projected date for publication of the new directive is July 1, 2007.

OIG Analysis:

The corrective action addresses the intent of this recommendation. This recommendation will be closed when OIG evaluates the revised Management Directive containing the drug testing policy and procedures that employees are expected to follow.

Status:

Resolved.
