REVIEW OF ARIZONA PUBLIC SERVICE COMPANY LETTER DATED NOVEMBER 16, 2006, INVOLVING THE REMAINING CORRECTIVE ACTIONS FOR THE CONTAINMENT SUMP VOIDING YELLOW FINDING

Dear Mr Levine:

Thank you for your letter of November 16, 2006, in response to our open items described in NRC Followup Supplemental Inspection Report 05000528/2006-010; 05000529/2006-010; and 05000530/2006-010, dated October 11, 2006. This inspection was conducted in order to assess your actions in response to the Yellow finding involving the voiding of emergency core cooling system piping in all three units. We have reviewed the closure action plan described in your reply and find it responsive to the concerns raised in the inspection report. As discussed in our inspection report, as well as, during a September 7, 2006, public meeting, Focus Area 3, Lack of Questioning Attitude and Technical Rigor of Individuals, and success measures required additional action before the NRC could conclude that these areas are successfully addressed to support closure of the Yellow finding.

As discussed during public meetings and in NRC correspondence, your previous action plans were not fully successful in correcting all the underlying causes of the Yellow finding and your effectiveness reviews did not result in additional corrective actions being taken prior to your requests for NRC inspection. Before the NRC inspects this area for the third time we understand that Arizona Public Service Company will complete a thorough assessment and implement any additional actions needed to improve performance. The NRC will review the implementation and effectiveness of your corrective actions following notification from Arizona Public Service Company that the measures implemented at the Palo Verde Nuclear Generating Station have shown the desired results to support reinspection of the open items described in the NRCs Followup Supplemental Inspection Report. Elements of this reinspection scope will include an assessment of the actions described in your November 16, 2006, letter and actions described in your integrated improvement plan as they relate to the open items.
