Dear Mr. Kansler:
By letter dated June 30, 2006 (Agencywide Documents Access and Management System Accession No. ML061870469), Entergy Nuclear Operations, Inc. submitted a request to amend the operating license for the Pilgrim Nuclear Power Station by revising the Technical Specification (TS) Surveillance requirements (SRs) for the HPCI and RCIC system. Specifically you requested to modify the test frequency of the HPCI and RCIC systems in Pilgrim TS SR 4.5.C.1.d and SR 4.5.D.1.d, to require the current specified flow rate test be performed only following maintenance activities that could have affected system flow rate performance.
The purpose of this letter is to provide the results of the Nuclear Regulatory Commission (NRC) staff's acceptance review of your application. The acceptance review determines whether or not there is sufficient detail to allow the NRC staff to proceed with a comprehensive technical review. The review also ensures that the application adequately characterizes the regulatory requirements and licensing basis of the plant.
The NRC staff has reviewed your application and has determined that your request would not conform to NRC requirements. Specifically, it does not conform to the framework as outlined in the Final Commission Policy Statement on Technical Specification Improvements for Nuclear Power Reactors, dated July 22, 1993 (58 FR 39132). This policy statement was subsequently codified by changes to Section 36 of Part 50 of Title 10 of the Code of Federal Regulations (10 CFR 50.36) (see also 60 FR 36953, July 16, 1995). In addition, the application does not provide technical information in sufficient detail to enable the NRC staff to make an assessment in regards to the increased or decreased probabilities of system in-operability or the increased consequences to overall plant risk as a result of not performing the TS SRs as prescribed by your custom TSs or the Standard Technical Specifications for Boiling Water Reactors NUREG-1433, Revision 3, June 2004.
During a conference call on September 21, 2006, the NRC staff informed you that we would not accept your amendment application for review because it does not meet the requirements of 10 CFR 50.36 as stated above, Therefore we are closing TAC No. MD2476 effective on the date of this letter.
