SUBJECT: EDWIN I. HATCH NUCLEAR PLANT - NRC MATERIAL CONTROL AND

ACCOUNTING PROGRAM INSPECTION REPORT NO. 05000321/2006-401

AND 05000366/2006-401

Dear Mr. Stinson:

On August 18, 2006, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection

of the material control and accounting program at the Edwin I. Hatch Nuclear Plant. The

purpose of the inspection was to review the circumstances pertaining to the reported discovery

of fragments of irradiated fuel rods in the Unit 1 Spent Fuel Pool which were not included in

your annual physical inventories of Special Nuclear Material (SNM) and the reported loss of

SNM in the form of approximately 18 inches (in the aggregate) of an irradiated fuel rod. The

enclosed inspection report documents the inspection findings, which were discussed during an

exit meeting on August 18, 2006, with Mr. Dennis Madison and other members of your staff.

The inspection results were further discussed with members of your staff during a telephone

conversation on September 27, 2006.

The inspection examined activities conducted under your license as they relate to safety and

compliance with the Commissions rules and regulations and with the conditions of your license.

Within these areas, the inspection consisted of a selected examination of procedures and

representative records, observations of activities, and interviews with personnel.

Based on the results of this inspection, an apparent violation of 10 CFR 74.19 was identified

and is being considered for escalated enforcement action in accordance with the NRC

Enforcement Policy. The current Enforcement Policy is included on the NRCs Web site at

www.nrc.gov; select What We Do, Enforcement, then Enforcement Policy. The

circumstances surrounding the apparent violation, the significance of the issues, and the need

for lasting and effective corrective action were discussed with members of your staff at the

inspection exit meeting. As a result, it may not be necessary to conduct a predecisional

enforcement conference in order to enable the NRC to make an enforcement decision.

Before the NRC makes its enforcement decision, we are providing you an opportunity to either:

(1) respond to the apparent violation(s) addressed in this inspection report within 30 days of the

date of this letter or (2) request a predecisional enforcement conference. If a conference is

held, it will be open for public observation. Please contact Scott Shaeffer at (404)562-4521

within 7 days of the date of this letter to notify the NRC of your intended response.

If you choose to provide a written response, it should be clearly marked as a "Response to An

Apparent Violation in Inspection Report No. 50-321/2006-401, 50-366/2006-401; EA-06-013"

and should include for each apparent violation: (1) the reason for the apparent violation, or, if

contested, the basis for disputing the apparent violation; (2) the corrective steps that have been

taken and the results achieved; (3) the corrective steps that will be taken to avoid further

violations; and (4) the date when full compliance will be achieved. Your response may

reference or include previously docketed correspondence, if the correspondence adequately

addresses the required response. If an adequate response is not received within the time

specified or an extension of time has not been granted by the NRC, the NRC will proceed with

its enforcement decision or schedule a predecisional enforcement conference.

In accordance with 10 CFR 2.390 and the NRCs Rules of Practice, a copy of this letter will be

available electronically for public inspection in the NRC Public Document Room or from the

Publicly Available Records (PARS) component of NRCs document system, ADAMS. ADAMS

is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (The Public

Electronic Reading Room). However, because of the security-related concerns contained in the

enclosure, and in accordance with 10 CFR 2.390, a copy of this letters enclosure will not be

available for public inspection.
