NRC RECEIPT OF FITZPATRICK NUCLEAR POWER PLANT RESPONSE TO GENERIC LETTER 2006-03, POTENTIALLY NONCONFORMING HEMYC AND MT FIRE BARRIER CONFIGURATIONS (TAC NO. MD1581)

Dear Mr. Kansler:

The Nuclear Regulatory Commission (NRC) acknowledges the receipt of your response, dated June 7, 2006 (Agencywide Documents Access and Management System (ADAMS) accession number ML061650025), to Generic Letter (GL) 2006-03, Potentially Nonconforming Hemyc and MT Fire Barrier Configurations. Under oath or affirmation, you stated that the James A.

FitzPatrick Nuclear Power Plant (JAFNPP) does rely on the Hemyc fire barrier system in one fire area, and you had requested an exemption. The NRC issued an exemption for the JAFNPP Hemyc fire wrap on September 27, 2006, ADAMS accession number ML062190377.

Your response stated that an FP-60 cable wrap is also used to separate safe shutdown trains located within the same fire area where the Hemyc fire wrap is located, and it has not been designed and installed in accordance with current NRC guidance. The NRC issued an exemption for the FP-60 fire wrap on May 29, 2001, ADAMS accession number ML010790125.

Therefore, the NRC staff finds that you have properly addressed the concerns with the Hemyc and MT fire barrier systems, and finds your response to GL 2006-03 to be satisfactory.
