In the Matter of ) Docket Nos. 50-438 Tennessee Valley Authority ) 50-439 BELLEFONTE NUCLEAR PLANT (BLN) UNITS 1 AND 2 - WITHDRAWAL OF CONSTRUCTION PERMITS CPPR-122 (UNIT 1) AND CPPR-123 (UNIT 2)-

SUPPLEMENTAL INFORMATION This letter provides supplemental information to TVA's letter to NRC dated April 6, 2006, requesting NRC's approval to withdraw BLN construction permits in accordance with Generic Letter 87-15, "Policy Statement on Deferred Plants."

During a conference call with the NRC Project Manager on June 21, 2006, TVA was asked to provide additional information regarding whether the subject BLN units can be considered a "Utilization Facility" as defined in 10 CFR 50.2 as follows:

Utilization facility means any nuclearreactorother than one designed or used primarilyfor the formation of plutonium or U-233.

In their present condition, neither of the subject units can be considered a utilization facility as so defined. At the time that construction of the units was deferred, TVA considered Unit 1 to be 88 percent complete and Unit 2 to be 58 percent complete.

At this time, neither reactor has the necessary structures, systems or components in place to sustain a controlled nuclear reaction. For example, over the past several years, key components such as the control rod drive mechanisms for both Unit 1 and 2 have been removed from the site which precludes the ability of the units to operate as nuclear reactors. In addition, as stated in TVA's letter of April 6, 2006, there is no nuclear fuel located at the BLN site.
