DG-1145, Page D-1 D. IMPLEMENTATION The purpose of this section is to provide information to applicants regarding the NRC staffs plans for using this draft regulatory guide. This draft regulatory guide applies only to new plants, and no backfitting is intended or approved in connection with its issuance.

The NRC has issued this draft guide to encourage public participation in its development. Except in those cases in which an applicant proposes or has previously established an acceptable alternative method for complying with specified portions of the NRCs regulations, the methods to be described in the final guide will reflect public comments and will be used in evaluating submittals in connection with applications for combined licenses.

REGULATORY ANALYSIS The NRC staff did not prepare a separate regulatory analysis for this regulatory guide. Rather, the regulatory analysis prepared for the updated Part 52 Rule [71 FR 12781] also provides the regulatory basis for this guide and examines the costs and benefits of implementing the rule. The Commission requests public comments on the draft regulatory analysis, as well as this draft regulatory guide. Interested parties may submit comments on the draft analysis to the NRC as indicated in the ADDRESSES section of the proposed Part 52 Rule.

A copy of the draft regulatory analysis for the proposed Part 52 Rule is available for inspection and copying for a fee at the NRCs Public Document Room (PDR), which is located at 11555 Rockville Pike, Rockville, Maryland. The PDRs mailing address is USNRC PDR, Washington, DC 20555-0001.

BACKFIT ANALYSIS This regulatory guide proposes NRC staff guidance on how COL applicants can comply with 10 CFR Part 52. Since no COL applications have been submitted to date, publication of this regulatory guide does not constitute a backfit under 10 CFR 50.109, and no backfit analysis is necessary or has been prepared for this regulatory guide.
