ST. LUCIE NUCLEAR PLANT, UNIT NOS. 1 AND 2, TURKEY POINT NUCLEAR PLANT, UNIT NOS. 3 AND 4, SEABROOK STATION, UNIT NO. 1, AND DUANE ARNOLD ENERGY CENTER - ORDERS APPROVING APPLICATION REGARDING PROPOSED CORPORATE MERGER (TAC NOS. MC9651, MC9652, MC9653, MC9654, MC9655 AND MC9656)

Dear Mr. Stall:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the application dated January 20, 2006, filed by Florida Power and Light Company, FPL Energy Seabrook, LLC, and FPL Energy Duane Arnold, LLC. The application, pursuant to Section 50.80 of Title 10 of the Code of Federal Regulations, sought approval of the proposed indirect transfer of the operating licenses as held by the foregoing licensees for St. Lucie Nuclear Plant, Units 1 and 2, Turkey Point Nuclear Plant, Units 3 and 4, Seabrook Nuclear Station, Unit 1, and the Duane Arnold Energy Center to the extent effected by the proposed merger of FPL Group, Inc., and Constellation Energy Group, Inc. The enclosed Orders (Enclosure 1) approve the proposed indirect license transfers. The Orders will be placed in the NRC public document room (PDR), added to the Agencywide Documents Access and Management System Publicly Available Records System (ADAMS PARS) Library and will be forwarded to the Office of the Federal Register for publication. is the NRC staffs safety evaluation (SE) related to the preceding actions. Your January 20, 2006, submittal provided certain confidential commercial information relating to the Seabrook and Duane Arnold plants, which you requested to be withheld from public disclosure pursuant to 10 CFR 2.390(a)(4) and 10 CFR 9.17(a)(4). You letter included an affidavit in support of this request. The NRC staff reviewed your request and determined that the information sought to be withheld did contain proprietary commercial information. Since some of this information is discussed in the SE, Enclosure 2 will be withheld from public disclosure. is a nonproprietary version of the SE that will be placed in the NRC PDR and added to the ADAMS PARS Library.
