STATUS OF 2.206 PETITION REGARDING PALISADES NUCLEAR PLANT
Dear Mr. Lodge:
A letter dated May 4, 2006, was sent to you regarding your 10 CFR 2.206 petition, dated April 4, 2006. The petition is related to the independent spent fuel storage installation (ISFSI) concrete pads at the Palisades Nuclear Plant (PNP). Your petition requested that the U.S.
Nuclear Regulatory Commission (NRC) take enforcement action against PNP by condemning and stopping the use of the two ISFSI pads. You stated that the concrete cask storage pads do not conform with NRC regulations for earthquake stability and therefore pose a hazard in the event of an earthquake. Your petition is under review by the staff and a determination will be made on the NRC action within a reasonable time.
We conducted a telephone conference with some of your representatives on April 26, 2006, to discuss your petition. Your representatives stated that a supplement to your petition was forthcoming following receipt of the telephone transcription. The transcript was sent by letter dated May 3, 2006, and emailed on May 4, 2006. We have not received the supplement as expected; however, we are continuing to process your petition in accordance with our 10 CFR 2.206 review process. Management Directive 8.11, Review Process for 10 CFR 2.206 Petitions, delineates the process and was enclosed with the letter dated May 4, 2006.
