ACKNOWLEDGMENT LETTER ALLOWING A SUPPLEMENT TO 2.206 PETITION REGARDING PALISADES NUCLEAR PLANT

Dear Mr. Lodge:

Your petition dated April 4, 2006, and addressed to Mr. Luis A. Reyes, Executive Director for Operations, has been referred to me pursuant to 10 CFR 2.206 of the Commission's regulations. You request that the U.S. Nuclear Regulatory Commission (NRC) take enforcement action against Palisades Nuclear Plant, by condemning and stopping the use of the two independent spent fuel storage installation concrete pads on the plant site. As the basis for your request, you state that the concrete cask storage pads do not conform with NRC regulations for earthquake stability and therefore pose a hazard in the event of an earthquake.

Thank you for bringing these matters to the attention of the NRC.

Your representatives spoke with our Petition Review Board (PRB) on April 26, 2006, to discuss your petition. We agreed with your representatives to allow a supplement to your petition, in lieu of another telephone discussion. The supplement is due to us a week after you receive your copy of the April 26, 2006, transcribed phone discussion, which will be sent to you as soon as possible. The content of that supplement will also be considered in the PRB's determination of whether your petition is accepted for review, and if accepted, in establishing the schedule for the review of your petition. Your supplement should be sent to L. Raynard Wharton, U.S.

As provided by Section 2.206, we will take action on your request within a reasonable time.

Ray Wharton is the manager for your petition. He can be reached at 301-415-1396. Your petition is being reviewed by the Spent Fuel Project Office, within the Office of Nuclear Material Safety and Safeguards. I have referred the two assertions Mr. Wharton spoke to you about, on April 25, 2006, to the NRC Office of the Inspector General. I have also enclosed, for your information, a copy of Management Directive 8.11, "Review Process for 10 CFR 2.206
