-287 Request for Relief 04-ON-006 By letter dated September 20, 2004, Duke Power Company (Duke),

now Duke Power Company LLC d/b/a Duke Energy Carolinas, LLC, submitted Request for Relief 04-ON-006, seeking relief from the requirements of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code,Section XI.

A limited visual (VT-3) examination on a Letdown Filter Housing support on each unit did not meet the 100%

examination requirements due to interferences such as insulation and boron accumulation from minor leakage.

Duke concluded it was not practical to resolve those interferences at the time due to existing radiation levels.

Because this was the last outage in the ten year interval, this left Duke in non-compliance, so a relief was requested.

In response to a Request for Additional Information (RAI)

Duke found that the percentage coverage actually obtained was not adequately documented.

The Staff cannot justify approval of the relief without this information; therefore Duke wishes to withdraw the subject relief request from consideration.

Duke has entered this issue into its corrective action program.

In addition, Region II investigated this issue during a recent inspection and Duke expects it will be addressed in the associated report.

S. Nuclear Regulatory Commission May 18, 2006 Page 2 For your information, Duke has performed a subsequent inspection on Unit 2 which confirmed there are no functional concerns with the Letdown Filter housing supports.

It is expected that interferences to completing a 100% inspection will be resolved for all units during the 4th interval inspection period.
