GINNA NUCLEAR POWER PLANT, CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2, NINE MILE POINT NUCLEAR STATION, UNIT NOS. 1 AND 2, AND CALVERT CLIFFS INDEPENDENT SPENT FUEL STORAGE INSTALLATION - ORDERS APPROVING APPLICATION REGARDING PROPOSED CORPORATE MERGER (TAC NOS. MC9620, MC9621, MC9622, MC9623, AND MC9624)

Dear Mr. Heffley:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the application dated January 23, 2006, as supplemented by letters dated April 25 and May 25, 2006, filed by Constellation Generation Group, LLC, on behalf of R.E. Ginna Nuclear Power Plant, LLC, Calvert Cliffs Nuclear Power Plant, Inc., and Nine Mile Point Nuclear Station, LLC, for the R.E. Ginna Nuclear Power Plant, Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2, Nine Mile Point Nuclear Station, Unit Nos. 1 and 2, and Calvert Cliffs Independent Spent Fuel Storage Installation. The application, pursuant to Sections 50.80 and 72.50 of Title 10 of the Code of Federal Regulations, sought approval of the proposed indirect transfer of the licenses, as held by the foregoing licensees, to the extent effected by the proposed merger of Constellation Energy Group, Inc., and FPL Group, Inc. The enclosed Orders (Enclosure 1) approve the proposed indirect license transfers. The Orders will be placed in the NRC public document room (PDR), added to the Agencywide Documents Access and Management System Publicly Available Records System (ADAMS PARS) Library and will be forwarded to the Office of the Federal Register for publication. is the NRC staffs safety evaluation (SE) related to the preceding actions. In your January 23, 2006, application, as supplemented, you provided certain confidential commercial information relating to projected income statements, which you requested to be withheld from public disclosure pursuant to 10 CFR 2.390(a)(4) and 10 CFR 9.17(a)(4). On June 8, 2006, the NRC notified you that it had reviewed your request and determined that the information sought to be withheld did contain proprietary commercial information and would be withheld from public disclosure. Since some of this proprietary information is discussed in the SE, Enclosure 2 will
