KANSAS STATE UNIVERSITY NUCLEAR REACTOR FACILITY, REVISED EMERGENCY PLAN (TAC NO. MC4318)
Dear Mr. Whaley:
By letter dated November 13, 2002 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML023190219), as supplemented by letter on July 6, 2005 (ADAMS Accession No. ML051960517) and by email on December 23, 2005 (ADAMS Accession No. ML061240575), the Kansas State University (the licensee) submitted proposed changes to the Emergency Preparedness Plan for Facility Operating License No. R-88 for the Kansas State University Nuclear Reactor Facility.
The U.S. Nuclear Regulatory Commission (NRC, or Commission) staff has reviewed the proposed changes and determined that they do not decrease the effectiveness of the emergency plan and that the plan, as changed, continues to meet the requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Appendix E. Therefore, in accordance with 10 CFR 50.54(q), NRC approval of the changes is not required. Implementation of the changes may be subject to future inspection to confirm that they did not decrease the overall effectiveness of your emergency plan.
The staff reviewed the licensee Emergency Preparedness Plan and determined that the plan is in accordance with the following guidance:
NUREG-0849, Standard Review Plan for the Review and Evaluation of Emergency Plans for Research and Test Reactors; NRC Regulatory Guide 2.6, Emergency Planning for Research and Test Reactors; American National Standards Institute (ANSI)-15.16, Emergency Planning for Research Reactors; and NRC Information Notice 97-34, Deficiencies in Licensee Submittals Regarding Terminology for Radiological Emergency Action Levels in Accordance With the New Part 20.
