OF APRIL 5, 2006, PUBLIC MEETING WITH TENNESSEE VALLEY AUTHORITY REGARDING BROWNS FERRY FIRE PROTECTION PROGRAM (TAC MC8826)

On April 5, 2006, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a Category 1 public meeting with Tennessee Valley Authority (TVA, the licensee) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss the licensees approach for updating the Fire Protection Program for Browns Ferry Nuclear Plant (BFN) to reflect three-unit operation and the recovery of BFN Unit 1. The meeting was open to the general public. Enclosure 1 contains a list of participants, Enclosure 2 is a copy of TVAs presentation materials, and Enclosure 3 is a copy of NRC<s presentation.

BACKGROUND By letter dated January 3, 2006, NRC requested that TVA provide information regarding the fire protection program that will be implemented at BFN to support the recovery of Unit 1. In a letter dated February 28, 2006, TVA provided a draft version of BFN, Units 1, 2, 3 Fire Protection Report. The NRC staff requested the meeting to communicate its comments from reviewing the draft version of BFN, Units 1, 2, 3 Fire Protection Report.

SUMMARY

Two of TVAs stated goals for the recovery of BFN, Unit 1 are to maintain operational fidelity among the three BFN units, and use the same methodology as BFN Units 2 and 3 (e.g., similar modifications, manual actions, same shutdown paths). TVA stated that the Appendix R modifications are scheduled to be complete in the fall of 2006. The licensee stated that the changes to the BFN fire protection program would be made in accordance with its fire protection License Condition. The License Condition has a provision that allows the licensee to make changes to the fire protection program that do not adversely affect the licensees ability to achieve and maintain safe shutdown of the units during a fire.

The NRC staff informed TVA that BFN Unit 1 will be held to the same regulations and safety standards that other nuclear plants are required to satisfy. The NRC and TVA discussed the Commission-approved enforcement discretion policies that currently exist for fire protection programs. To ensure consistency with criteria that allowed past enforcement discretion to be granted by the Commission, TVA will need to identify noncompliances at all three BFN units and initiate corrective actions before September 6, 2006. The NRC staff emphasized that this expectation applies to all nuclear plants. Furthermore, the NRC staff informed TVA that BFN Unit 1 must fix or mitigate any risk-significant noncompliances prior to the restart of Unit 1.

May 30, 2006 The NRC staff provided preliminary comments on several aspects of the draft version of BFN, Units 1, 2, 3 Fire Protection Report that may be inconsistent with current regulatory requirements.

At the conclusion of the meeting, the licensee stated that it will evaluate its options for ensuring compliance with the applicable regulations, and may request a meeting at a later date to inform the staff of its plan.

No commitments or regulatory decisions were made by the NRC staff during the meeting.
