Dear Chairperson Diaz:

It was recently reported in the San Diego Union Tribune that a tanker truck transporting 4,500 ga~lons of wastewater from the San Onofre Nuclear Generating Station to a disposal site in the State of Utah was found to be leaking radioactive wastewater while en route to the disposal site.

The leak was ultimately discovered while the truck was physically located in Utah. However, the route taken from the plant to the disposal site required the truck to travel through both the states of California and Nevada.

While the San Diego Union Tribune article quotes a spokesperson at San Onofre stating that he "does not believe" that wastewater was spilled in either Nevada or California while the truck was in transit, we question the basis of that statement. As you are well aware, even a modest amount of leakage could pose significant health risks for communities through which the wastewater was transported. Arbitrarily dismissing the possibility that some of the leakage may have occurred in areas other than where it: was ultimately found could serve to make people less vigilant in investigating the spill and those living in potentially impacted areas less alert to possible exposure.

I expect a thorough investigation of this incident by the U.S. Nuclear Regulatory Commission. Prompt and full public disclosure of your findings is essential to ensure the public's confidence in the -

government's handling of this incident and, more importantly, it will help persuade the public that nuclear wastewater is being handled with their health and welfare foremost in everyone's mind.

I look forward to hearing from you at the earliest possible time as to the status of the Commission's investigation.
