Duke Energy Corporation McGuire Nuclear Station, Units 1 and 2 Docket Numbers 50-369 and 50-370 Catawba Nuclear Station, Units 1 and 2 Docket Numbers 50-413 and 50-414 Withdrawal of a Temporary License Amendment Request and Commitment for a Future Permanent License Amendment Request In a letter to the NRC dated October 13, 2005, Duke Energy Corporation (Duke) submitted a license amendment request (LAR) for the McGuire Nuclear Station, Unit 2 Facility Operating License and Technical Specifications (TS).

This LARF contained a temporary, one-time change that was applicable to TS 3.7.10, Control Room Area Chilled Water System (CRACWS).

This LAR was an administrative follow-up action for a Notice of Enforcement Discretion (NOED) request and applied to McGuire Unit 2 only.

This NOED was discussed with NRC officials in a telephone conference call held on October 8, 2005.

Duke submitted the written NOED in a letter to the NRC dated October 12, 2005.

Based upon further direction from NRC officials, it has been determined that this temporary TS change is not required.

Thus, Duke is hereby withdrawing the October 13, 2005 LAR.

Note that the October 8, 2005 McGuire Unit 2 event was further discussed in Licensee Event Report (LER) 370/2005-07 that was submitted to the NRC by Duke letter dated December 1, 2005.

Nuclear Regulatory Commission March 7, 2006 Page 2 Duke will pursue a future, permanent LAR for McGuire and Catawba Nuclear Stations that will address the issue of operability requirements for shared and unit-designated eqiipment on a shutdown unit, when this equipment is relied upon to support an operating unit in Modes 1 thru 4.

This issue, as applied to the CRACWS and TS 3.7.10 as discussed above, was identified as a contributing cause for the October 8, 2005 NOED request and the December 1, 2005 LER for McGuire Unit 2.

This future LAR will be submitted by December 31, 2006.

There are no additional regulatory commitments contained within this submittal.

Pursuant to 10 CFR 50.91, a copy of this LAR withdrawal is being sent to the designated official of the State of North Carolina.
