HADDAM NECK PLANT - REQUEST FOR RELIEF FROM 10 CFR Part 50.70(b)(1) (TAC NO. L60600)

Dear Mr. Norton:

By letter dated March 10, 2006 (ML060800488), Connecticut Yankee Atomic Power Company (CY) requested relief for the Haddam Neck Plant (HNP) from the 10 CFR Part 50.70(b)(1) requirement for each licensee, upon request by the Director of the Office of Nuclear Reactor Regulation, to provide rent-free space for the exclusive use of Commission inspection personnel.

The U.S. Nuclear Regulatory Commission (NRC) understands that, due to decommissioning activities, numerous structures and onsite buildings are in the process of being demolished, including the Administration Building, which is scheduled for demolition in July 2006. The Administration Building currently houses the office reserved exclusively for NRC inspection personnel. As a result of decommissioning activities, site office space will be limited to a few offices in the Emergency Operations Facility (EOF) building and temporary trailers for use by site operations and support personnel as well as NRC inspection personnel during brief periods when they are onsite. This office space will be further reduced as subsequent decommissioning phases are completed and temporary trailers are moved offsite commensurate with a reduction in the workforce.

CY has stated that they intend to continue to provide office space for NRC inspection personnel on an as-needed basis when those personnel are onsite. However, in its effort to minimize the need for any additional office space as it enters the demobilization phase of the project, CY desires to utilize NRC office space for site operations and support staff when NRC inspection personnel are not onsite.

W. Norton Given the office space limitations associated with decommissioning the HNP site, and CYs commitment to provide suitable space on an as-needed basis, NRC withdraws its request for office space for the exclusive use of Commission inspection personnel.
