FitzPatrick Nuclear Power Plant Fitness-for-Duty Program Performance Report For the Period July through December 2005 INTRODUCTION 10 CFR 26.71 (d) requires that nuclear power plant licensees periodically collect, compile and submit Fitness-for-Duty performance data. Specifically, this performance data must include:

1. Random testing rate;
2. Drugs tested for and cut-off levels, including results of tests using lower cut-off levels;
3. Workforce populations tested;
4. Numbers of tests and results by population, and type of test (i.e., pre-access, random, for-cause, etc.);
5. Substances identified;
6. Summary of management actions; and
7. A list of events reported.

Fitness-for-Duty performance data for Entergy's James A. FitzPatrick Nuclear Power Plant (JAF) for the period July 2005 through December 2005 are provided below and in the attached tables. Data on random testing rate, a summary of management actions, and a list of events reported (items 1, 6 and 7) are given below. Data for the remaining items (2, 3, 4 and 5) are given in the attached tables.

An additional section not required by 10 CFR 26 is included in this report. The additional section summarizes events related to the FitzPatrick Fitness-for-Duty Program and lessons learned.

At JAF, Entergy considers all contractors to be short-term contractors for the purposes of the Fitness-for-Duty Program. For this reason, the attached tables show "zeros" for data associated with long-term contractors.

RANDOM TESTING RATE For this period, 23.60% of the workforce was tested randomly. The annual testing rate for 2005 was 53.16%.

SUMMARY

OF MANAGEMENT ACTIONS Entergy used the definition of "Management Actions" implicit in 10 CFR 26.27

("Management actions and sanctions to be imposed") to determine the content of this section.

Pre-Access Testing A total of 99 pre-access tests (10-employees, 89-contractors) were administered. One pre-access test for a contractor was positive for Marijuana. Access was denied. All other tests were negative.

Random Testing A total of 215 random tests (199-employees, 16-contractors) were administered. One employee tested positive for alcohol. A mandatory EAP referral was initiated. Employee returned to work and was placed in the follow-up program after signing a re-entry agreement.

For Cause Testing One employee for-cause test was performed during this period, after reporting a DWI arrest; the test was negative. Employee was placed in the follow-up program, with full access.

Follow-Up Testing There were 13 follow up tests (11-employees and 2-contractors) administered during this reporting period. All test results were negative.

Other This category includes tests repeated because the results of the specimen were negative but the specimen was determined by the laboratory to have either a low specific gravity or a low concentration of creatinine. There were 6 atypical tests, 5 employees and 1 contractor.

All repeat observed test results were negative. There were 5 Department of Transportation (DOT) tests performed (which had a lower alcohol cutoff level at 0.02% BAC). The test results were negative.

Events Reported There were no reportable events during this period. No performance indicators were identified during this period.

Lessons Learned and Program Events There were no program events during this period.

The random testing rate, a summary of management actions, and a list of events reported (items 1, 6, and 7) are given below. Data for the remaining items (2, 3, 4 and 5) are given in the attached tables.

An additional section not required by 10CFR26 is included in this report. The additional section summarizes events related to the IPEC Fitness-For- Duty program and lessons learned.

At IPEC, Entergy considers all contractors to be short-term for the purposes of the Fitness-For-Duty program. For this reason, the attached tables show "zeros" for data associated with long-term contractors.

RANDOM TESTING RATE For this period, 24.34% of the workforce was tested randomly. The annual testing rate for 2005 was 51.07%.

ATTACHED II TO JPN-06-001 / NL-06-024 / ENO 2.06.012 / BVY 06-016 Pre-Access Testing A total of 249 pre-access tests were performed (90-employees and 159-contractors). All employee tests were negative. Two contractor tests were positive (1-cocaine and 1-PCP).

Both individuals were denied access to the site for three years.

Random Testing A total of 404 random tests were performed (355-employees and 49-contractors). All employee tests and all contractor tests were negative.

For-Cause Testing A total of 12 for-cause (9-employee and 3 contractors) tests were performed (ten tests were for observed behavior and two tests were post accident). All employee tests were negative.

One (1) contractor (observed behavior) tested positive for alcohol. The individual was denied access to the site for one year.

Follow-Up Testing A total of 8 follow-up (5-employee and 3-contractor) tests were performed. All contractor tests were negative. One (1) employee tested positive for alcohol. The employee was a supervisor and per regulations the NRC was notified. Individual was permanently denied access to site per company procedure.

Other This category includes tests repeated because the results of the specimen were negative but the specimen was determined by the laboratory to have either a low specific gravity or a low concentration of creatinine. A total of eleven (4) tests were performed (1-employee and 3 contractors). All tests were negative.

Events Reported There were no additional reportable events during this period. No performance indicators were identified during this period.

Lessons Learned and Program Events There were no program events during this period.

All licensee and long term contractor pre-access tests results were negative. 5 short term contractor pre-access tests received positive results (2 tests were positive for marijuana > 50; 1 test was positive for marijuana > 100; 1 test was positive for alcohol and 1 test was positive due to a refusal to test). These 5 short term contractors were all denied access.

Random Testing A total of 265 random tests (170 licensee employees, 32 long term contractors, and 63 short term contractors) were administered during this period. 2 random tests received positive results (1 licensee employee test was positive for alcohol and 1 short term contractor test was positive for marijuana > 100). Both individuals were denied access. The licensee employee returned to work after the required 14 days off with EAP intervention and is currently in a follow-up program.

For Cause Testing (Observed Behavior and Post Accident)

A total of 2 for-cause tests (1 observed behavior and 1 post accident) were administered during this period. The observed behavior test was a licensee employee who received a positive result for alcohol. The licensee employee (a college intern) was denied access. He elected not to participate in EAP and did not return to the plant. Access was denied for one year. The post accident test was for a short term contractor who received a negative test result.

Follow UP Testing A total of 37 follow-up tests (8 licensee employees, 4 long term contractors, and 25 short term contractors) were administered during this period. All follow-up test resulits were negative.

Other This category includes tests repeated because the results of the specimen were negative but the specimen was determined by the laboratory to have either a low specific gravity or a low concentration of creatinine. There were 15 atypical tests (1 licensee employee and 14 short term contractors) administered during this period. All licensee test results were negative. 1 short term contractor received a positive result for marijuana > 1000. He was denied access.

Events Reported There were no reportable events during this period. No performance indicators were identified during this period.

ATTACHMENT IV TO JPN-06-001 / NL-06-024 / ENO 2.06.012 / BVY 06-016 Lessons Learned and Program Events During the 3rd quarter, VY did not meet the 10% blind sample submittal as required (although the combined average rate for the 3rd and 4 th quarters was over 10%/c,). This was due to the much higher number of contractors brought in to support the outage during the last weeks of the 3T quarter. A condition report (CR-VTY-2005-034341 was generated.

Additional blind samples were sent to the lab in the beginning of the 4t quarter to raise the average to above 10%.
