OF JANUARY 19, 2006, MEETING WITH PPL SUSQUEHANNA, LLC TO DISCUSS AN IMPENDING EXEMPTION REQUEST TO CERTIFICATE OF COMPLIANCE 1004 On January 19, 2006, the U.S. Nuclear Regulatory Commission (NRC) staff from the Spent Fuel Project Office, and PPL Susquehanna, LLC (PPL) met at NRC Headquarters in Rockville, Maryland. The purpose of the meeting was to discuss an impending exemption request to Certificate of Compliance (CoC) 1004 to load Framatome ANP 9x9-2 fuel in the 61BT canister. is a list of attendees. Enclosure 2 contains the handouts from the meeting.

Highlights of the Meeting PPL explained that they need an exemption request to the CoC for the Standardized NUHOMS Horizontal Storage System for Irradiated Nuclear Fuel (CoC 1004). The reason for the exemption request is that the Framatome ANP 9X9-2 fuel that Susquehanna would like to load is not completely enveloped by the fuel assembly design characteristics of the General Electric (GE) 9X9 fuel that is included in CoC 1004. During the meeting PPL described the need for the request, the proposed time line for the request, the technical content of the exemption request, and the duration of the proposed exemption request. PPL also provided a draft of the exemption request, which is included in Enclosure 2.

PPL explained that the proposed technical content of the request would include a determination that in most areas (with the exception of the criticality analysis) the Framatome 9X9-2 fuel is enveloped by the GE 9X9 fuel described in CoC 1004. The proposed technical content of the request would include criticality analysis because the GE 9X9 fuel contains 66 full and 8 partial-length fuel rods while the Framatome 9X9-2 fuel contains 79 full-length rods and no partial-length rods. PPL also indicated that it intended to submit a simplified thermal analysis to demonstrate that the fuel it intended to load would remain under the thermal limits provided in Interim Staff Guidance (ISG) 11, Revision 3.

W. Ruland The staff stated that it had not reviewed the draft exemption request in detail. However, based on its cursory review of the material in Enclosure 2 and the discussion during the meeting the staff stated that PPL should consider adding the following information to its exemption request:

C In the criticality area, PPL should include its design basis case computer modeling calculations and design specifications used in the calculations as part of the submittal so that the staff can use the data to perform an independent calculation.

C The exemption request should state more clearly the justification for PPL proposing that the staff process it by the beginning of April 2006, when PPL is not expected to loose full core offload capability until late 2006.

C In addition to other 10 CFR Part 72 citations mentioned in the draft exemption request, PPLs exemption request should also reference 10 CFR 72.212(a)(2) and 72.214.

C The exemption request cover letter should reference PPLs Part 72 docket (72-28)

The staff cautioned PPL that it still needs to perform a detailed review of the exemption request and additional questions may be asked after the exemption is submitted including questions regarding the simplified thermal analysis that PPL intends to provide. The staff also stated that it would consider placing bounds on the use of the exemption request in the future. PPL proposed the length of the exemption request be tied to CoC 1004 proposed Amendment 9.

This proposed amendment is intended to capture the Framatome 9X9-2 fuel along with many other revisions. The staff has not yet received this proposed amendment, and may not accept the amendment after the staff performs a detailed technical analysis. The staff stated that it would most likely place a time-limit on the use of the exemption request other than what PPL proposed in its draft letter.
