50-269, 270 and 287 Duke Energy Response to NRC Preliminary Greater Than Green Finding Letter Dated December 19, 2005 Duke Energy Corporation (Duke) is in receipt of the referenced Nuclear Regulatory Commission (NRC) preliminary greater than green finding letter along with the Significance Determination Process (SDP) Phase 3 Summary attachment dated December 19, 2005.

This letter describes a qualitative risk evaluation of the potential for loss of Unit 3 control room function following certain tornado events.

The letter further stated that corrective actions had not been promptly taken to resolve tornado-related concerns with the Unit 3 north control room wall.

NRC Region II staff was notified previously, by phone, that Duke has decided to participate in a Regulatory Conference to discuss details of the preliminary risk findings.

The purpose of this letter is to confirm that decision.
