Acknowledgment of Receipt of Denial of Noncited Violations and Finding in NRC
Inspection Report 05000313/2005004 AND 05000368/2005004
Dear Mr. Forbes:
Thank you for your letter dated December 19, 2005, in response to our November 19, 2005,
letter and integrated inspection report. In your letter you contested the significance of one
Green finding concerning the failure to adequately scope the effects of maintenance on
pressurizer level instrumentation. You also disagreed with the characterization that two other
findings identified as noncited violations were violations of NRC regulations. These two findings
were documented in the inspection report as a noncited violation of 10 CFR 50.65(a)(4)
concerning the failure to adequately assess risk for an isolated electromatic relief valve, and a
noncited violation involving inadequate procedures leading to reactor coolant pump seal
damage. The NRC also determined that these findings contained crosscutting aspects in the
area of human performance. You requested that the NRC withdraw the three findings along
with the associated crosscutting aspects.
The NRC is reviewing your request and will inform you of the results of our review by separate
correspondence.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and
your response (if any) will be made available electronically for public inspection in the NRC
Public Document Room or from the Publicly Available Records (PARS) component of the
NRCs document system (ADAMS). ADAMS is accessible from the NRC Web site at
