SAN ONOFRE NUCLEAR GENERATING STATION, UNITS 2 AND 3 - RE: CLOSEOUT OF TAC NUMBERS FOR PRE-APPLICATION REVIEW OF A POTENTIAL LICENSE AMENDMENT REQUEST FOR CREDITING SOLUBLE BORON IN SPENT FUEL POOL (TAC NOS. MC5917 AND MC5918) By the attached email dated February 9, 2005, Southern California Edison (the licensee) provided presentation slides that would be used in a telephone conference call with the Nuclear Regulatory Commission (NRC) staff on a draft license amendment request (LAR) for crediting soluble boron in spent fuel pool (SFP) being developed by the licensee for San Onofre Nuclear Generating Station (SONGS), Units 2 and 3. Attachment 2 is the content list of the licensee's presentation slides. The purpose of the call (page 3 of presentation slides) was for the licensee to (1) present an overview of the changes the licensee was considering to the SONGS Technical Specifications (TSs) to take credit for soluble boron in the SFP to control the shutdown margin of the spent fuel in the pool, (2) discuss the LAR submittal schedule and expected NRC review time, and (3) obtain any NRC comments on the expected changes to the TSs. This is a pre-application review that the NRC staff will conduct, if it has the time and resources, with the licensee in order to minimize the need for additional information for the NRC staff review of the LAR application. This review in no way constitutes approval of a proposed LAR, which in accordance with the regulations, must be submitted to NRC for its review and approval. On March 29, 2005, a conference call was held with the licensee to discuss the draft LAR for crediting soluble boron in the spent fuel pool, which is outlined in the licensee's presentation slides. Attachment 3 is the list of participants at the conference call. In the call, the licensee discussed its expected changes (called proposed changes in the presentation slides) to the following Limiting Conditions for Operation (LCOs) and the plant design features, in the SONGS TSs: 1. LCO 3.7.17, "Fuel Storage Pool Boron Concentrations," which are pages 10 and 11 in the licensee's presentation slides. 2. LCO 3.7.18, "Spent Fuel Assembly Storage," which are pages 12 through 16 in the licensee's presentation slides. 3. Chapter 4.0, "Design Features," which are pages 17 through 19 in the licensee's presentation slides. The licensee also presented the identified changes to its Control Specification, pages 21 through 36 in the presentation slides, however, this document is not part of the SONGS TSs. The licensee stated that the draft changes to the TSs followed the improved Standard Technical Specifications, NUREG-1432, "Standard Technical Specifications Combustion Engineering Plants," Revision 3. This would be the standard TSs for SONGS, Units 2 and 3. The NRC staff stated that it agreed with the licensee that the licensee's identified changes to the TSs for crediting soluble boron in the SFP follows NUREG-1432, which is the applicable standard TSs for SONGS, Units 2 and 3. Also, the NRC staff stated that it appeared that the licensee would be proposing TS changes that should be acceptable; however, this judgement was only in the context that (1) the identified areas of change in the TSs are the areas that needed to be changed, (2) the identified changes were not obviously incorrect for crediting soluble boron in the TSs, and (3) the plant-specific justification for the identified TS changes, which must be submitted with an LAR application, has not been submitted or reviewed by the NRC staff, and this plant-specific justification could identify that additional TS changes were needed. The NRC staff also stated that it did not see any other areas of the TSs that would need to be changed for crediting soluble boron in the SFP. The licensee stated that it anticipated it would be submitting its LAR application in May 2005 and would be requesting a 12-month review of the application by the NRC. The NRC staff stated that at the time of the call that it could not promise the review could be completed in that time frame. The conference call was concluded. This memo closes the subject TAC Nos.
