KEWAUNEE NUCLEAR POWER PLANT - QUALITY ASSURANCE PLAN CHANGE (TAC NO. MC7586)

Dear Mr. Gaffney:

By letter to the Nuclear Regulatory Commission (NRC) dated October 31, 2003, Nuclear Management Company, LLC. (NMC) requested approval of a fleet Quality Assurance Topical Report (QATR) for the Kewaunee power station (Kewaunee). By letter dated March 24, 2005, the NRC issued the approval of the QATR. In July 2005, Dominion Energy Kewaunee Inc.

(DEK), became the licensee for Kewaunee. As a result of this change, by letter dated October 17, 2005, DEK stated that instead of implementing the approved NMC QATR at Kewaunee, it intends to implement the Dominion fleet Nuclear Facilities Quality Assurance Program Description (NFQAPD) Topical Report (DOM-QA-1). The NFQAPD has been reviewed and approved by the NRC by letter dated September 9, 2005, for use at other Dominion facilities.

DEK requested an extension until June 30, 2006, for the final implementation of the approved NFQAPD at Kewaunee.

It is the NRCs understanding that the current approved quality assurance (QA) program in place at Kewaunee will remain in effect until DEK chooses to implement the Dominion NFQAPD at Kewaunee. Changes to the QA program should be made In accordance with Title 10 of the Code of Federal Regulations, Part 50, Section 50.54(a)(4). Reductions in commitment to the current QA program, will need to be submitted with adequate justification for review and approval by the NRC.

In the October 17, 2005, letter, DEK made the following commitment:

Implement approved QATR (or 50.54(a)(3) alternative by June 30, 2005.

It is not clear from this commitment if DEK is going to implement the NMC QATR approved by the NRC or the Dominion NFQAPD. Please provide a follow up letter that clarifies your plans to change the QA program at Kewaunee. As indicated above, any changes to the approved QA program should be made in accordance with 10 CFR 50.54(a)(4). This completes the NRC staff actions under TAC No. MC7586.
