Access to Select Safeguards Information This letter notifies the Nuclear Regulatory Commission (NRC) of Calvert Cliffs Nuclear Power Plant, Inc.'s (CCNPP), willingness to sponsor Framatome ANP, Inc. (FANP), regarding access to selected safeguards information (SGI) during the preparation of its design certification application for the U.S.
Evolutionary Power Reactor (EPR). As you are aware, FANP has engaged in pre-application design certification discussions with the NRC Staff regarding its U.S. EPR technology.
Our research indicates that several agency communications, including SECY 03-0157, SECY 05-0120, and a recent press release (05-131, dated September 21, 2005), express the importance of new reactor vendors incorporating design basis threat (DBT) and related security information into their design and application activities.
Such activities may include identification and possible analyses of target sets, based on the current DBT requirements. By letter dated October 7, 2005, FANP has requested CCNPP sponsorship to allow authorized access to the relevant DBT and limited other related SGI in order to meet this objective.
We note that Westinghouse and General Electric previously sought, and were granted, access to limited SGI in their efforts to obtain certified designs for the AP1000 and the Economic Simplified Boiling Water Reactor, respectively.
To ensure that the SGI is protected in accordance with the requirements of 10 CFR73.21, CCNPP intends to allow FANP access to limited SGI by means of our current 10 CFR 73.21 programmatic controls and resources.
