SUMMARY
- DISCUSSION OF DIFFERENCES BETWEEN 10 CFR 50.68 AND 10 CFR PART 72, AS THESE ISSUES RELATE TO SURRY POWER STATION AND ITS INDEPENDENT SPENT FUEL STORAGE INSTALLATION On September 27, 2005, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of VEPCO at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of this meeting was to discuss the differences in the criticality analysis between Title 10 of the Code of Federal Regulations (10 CFR) Section 50.68 and 10 CFR Part 72, as these issues relate to Surry Power Station and its Independent Spent Fuel Storage Installation (ISFSI). A list of attendees is provided as Enclosure (1).
As shown in Enclosure (2), the VEPCO presented information contained in its handout, including a description of its ISFSI facility at Surry. Currently, there are two ISFSI pads that have a site specific licensee, with a third ISFSI pad under construction. Last year, the NRC staff renewed the license for the two ISFSI pads for an additional 40-years. In addition, VEPCO has received a 10 CFR 70.24 exemption for the site specific license. After the third pad has been completed, VEPCO plans to apply for a general license to use the NUHOMS fuel storage cask at this ISFSI pad. The NRC staff is reviewing the vendors application to use the NUHOMS cask system. VEPCO indicated it had expected the NRC staff to approve of this cask system by September 2005.
Regarding the application of a general license at the third ISFSI pad, VEPCO stated that it will need to submit a license amendment before using the NUHOMS fuel storage cask. This is because a general license must receive a 10 CFR Part 50 review, as it pertains to the spent fuel pool. Since the NUHOMS cask is loaded in the spent fuel pool, VEPCO informed the NRC staff that it must comply with the requirements of 10 CFR 50.58 and 10 CFR Part 72. 10 CFR 50.68 requires licensees to maintain subcriticality in the spent fuel pool, using unborated water.
10 CFR Part 72 allows licensees to credit the use of soluble boron in the spent fuel pool. As such, VEPCO stated that it will be submitting a license amendment application that revises the spent fuel pool analysis at Surry and allows the use of the NUHOMS cask in the spent fuel pool.
VEPCO plans to submit this application in November 2005 and has requested NRC staff approval of this license amendment by June 30, 2006. VEPCO stated that this schedule is needed to support the implementation of the NUHOMS cask at Surry by August 1, 2006. The NRC staff indicated that VEPCO might not need a license amendment; however, the NRC staff stated that it would have to first review the licensing basis at Surry. Nevertheless, the NRC staff indicated that it would support VEPCOs schedule.
During this meeting the members of the public had several questions for the NRC staff regarding the use of the NUHOMS cask at the Oconee Nuclear Station ISFSI pad. Duke Energy stated that it was planning to use the NUHOMS cask at the Oconee ISFSI site and wanted to inquire about obtaining NRC staff approval of its license amendment. Duke stated that it plans to submit this amendment by February 2006. Because Duke plans to start using the NUHOMS cask during the month of July 2006, Duke wanted to know if the NRC staff could approve of this amendment by June 2006. The NRC staff indicated that it would support Dukes schedule.
