h had raised a concern regarding procedural noncompliance with the nsient Assessment Response Plan (TAR P) vi PSEG's Corrective Action Program.

_ aaimed that as a result of raising the concer, several adverse actions were taken againstncluding suspension of employment and threats of a poor performance appralsal.

On January 9, 2003, 01 initiated an Investigation (01 Case No. 1-2003-010) nt claim of discrimination. On July 25, 2003, the case was closed and Issued as substantia ad.

In a September 2, 2003, supplemental Information package to th"RC Indicated that PSEG washowing a continuing pattern of discrimination sinstakig medication that precludesfrom uem nznthe TARP *teamn (the Medical Departent at PSEG Is aware of the medication) ybt@0Ereceived antunsatisfactoryinid-year performance appraisal on August 28, 200X.

On September 22, 2003, a RegloD I All g n Review Board (ARB) was held wherein DRP advised the ARB that a review ofI eptember 2nd information package had been completed andjthat no new technical Issues were identified. The ARB determined that 0I should re M eA information package and performance appraisal, and contact if necessary, for clarifying Information.

Potential violations Include 10 CFR 50.5 (Deliberate misconduct) and 10 CFR 50.7 (Employee protection). The statute of limitations tolls on, or about, August 28, 2008. Status: FWP ECD (90 days): 12103.
