However, when as contacted by Ol in an effort to schedule a formal Interview, i*~J advised C dlarad sharedaWotential discrimination concerns with the PSE8LG LThuclearEmployee Concerns Program, desired that the ECP investigate, and indicated thaw did not want to be interviewed by 01 at that time. Therefore, the 01 case was closed (unsubstantiated) on September 27, 2002.
On January 8, 2003, a Region I ARB was field where ft was determined tha had again articulated a prima facie showing of discrimination based on the same fact pattern. The ARB agreed that O would Initiate an investigation Into the potential discrimination.
Potential violations Include 10 CFR 50.5 (Deliberate misconduct) and I0 CFR 50.7 (Employee protection). The statute of limitations tolls on, or about, August 9, 2007. Status: FWP ECD (90 days): 04/03.
