MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN - VERMONT YANKEE NUCLEAR POWER STATION

Dear Mr. Thayer:

On August 3, 2005, the NRC staff completed its performance review of Vermont Yankee Nuclear Power Station for the first half of the calender year 2005 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results over the previous twelve months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include physical protection information. A separate letter designated and marked Exempt from Public Disclosure in accordance with 10 CFR 2.390" will include the physical protection review and resultant inspection plan.

Plant performance for the most recent quarter was in the Regulatory Response column of the NRCs Action Matrix. This is based on one White (low to moderate safety significance) inspection finding in the Emergency Preparedness Cornerstone. All PIs indicated a performance level requiring no additional NRC oversight (Green). The White finding involved not establishing the means to provide early notification and clear instruction to the populace within the emergency planning plume exposure pathway. The NRC supplemental inspection for this issue evaluated the extent of condition, root cause, and corrective actions. This finding was closed as discussed in Inspection Report 05000271/2005007, dated July 11, 2005.

Additionally, on June 22, 2005, the staff issued a severity level III Notice of Violation, in accordance with the NRCs Enforcement Policy, for misplacing two irradiated fuel pieces and not conducting adequate inventories of the location of the fuel pieces. Information regarding the reason for the violation, corrective actions, and when Vermont Yankee achieved full compliance with the regulatory requirements for this issue are discussed in Notice of Violation EA-04-174 and Special Inspection Report 05000271/2004007, dated December 2, 2004.

The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through March 31, 2007. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature.

The inspections in the last nine months of the inspection plan are tentative and may be revised at the end-of-cycle review.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
